At one time or another we have all heard someone say that he/she would make a great attorney because they can argue with a “fence post”. Trial advocacy is NOT arguing with one’s opponent, or for that matter, a Judge or jury. Trial advocacy IS the professional and competent presentation of a client’s legitimate issues to a judge or jury for a decision that cannot be resolved by negotiations, private treaty or settlement between opposing parties. Successful advocacy in the resolution of a client’s problems or conflicts rests not only on the facts and circumstances of the case as applied to the current state of the law, but just as importantly on the attorney’s ability to “persuade” either the opposing side or trier of fact (judge or jury) that your client’s position should and/or will prevail. Not all conflicts between parties find its way into the courtroom in front of either a judge and/or a jury. Although the client’s case is prepared from its beginning as if it will be decided in the courtroom, there usually are and will be times during the course of representing a client’s interests that opportunities arise to “settle” all the issues that are cost effective and expedient. The art of successful advocacy as to a civil or criminal case in either state or federal court has its foundation in your attorney’s formal legal education, training, professionalism and competency. Formal legal education, however, does not provide that degree and level of “experience” that is an indispensable part of the successful representation of the client. Experience is derived from years of dealing with real clients, issues and obtaining successful outcomes.
