ERISA Litigation

ERISA is a federal statute that governs most employee benefits, and which overrides many state laws.

Railroad Litigation

Collisions between vehicles and trains at railroad grade crossings are usually catastrophic or deadly. Unfortunately, train accidents continue to occur quite frequently. I am an experienced railroad litigation attorney who has the legal expertise to handle these types of cases. There are a variety of liability issues that need to be analyzed in evaluating and prosecuting railroad litigation claims. I handle all litigation related to rail crossing or train crossing injuries, including railroad litigation that is related to the negligence or error of the railroad employer or employee, the train crew, or incidents involving a railroad employee that has been injured as well as passengers who are involved with the train accident as well. I also handle claims relating to the Federal Employer’s Liability Act or F.E.L.A.

The negligence of the train crew must be evaluated from the perspective of the safe operation and control of the locomotive, the keeping of a proper lookout, speed of the train, emergency brake application, and the information in the event data recorder or black box must also be considered.

In addition to the potential operational negligence of the train crew, the safety aspects of the railroad highway grade crossing need to be analyzed as well. Engineering and human factors principles must be considered in this analysis. Familiarity with technical data published by the Federal Highway Administration, U.S. Department of Transportation, American Association of State Highway and Transportation Officials, and other state and local sources is an absolute must in determining whether a given railroad grade crossing is reasonably safe or an ultra hazardous crossing.
